Terms of Service

Last updated 3 October 2026

These terms cover your use of KiteGTM. By creating an account or using the product you agree to them.

Who you are contracting with

KiteGTM is a product of Inkris Technologies Inc., a company incorporated in the Province of Ontario, Canada, with its head office at 500 4 Ave SW, Calgary, AB T2P 2V6, Canada. “We” and “us” mean that company. “You” means the business using the product. These terms cover KiteGTM only; other Inkris products have their own terms.

Your account

You need an account to save a market. Keep your credentials secure, and tell us at support@kitegtm.com if you think someone else has access. You are responsible for what happens under your account, including anything your team members do. Team members, roles, and permissions are unlimited and free on every plan.

The free plan and the paid plans

The free plan gives you the platform to do the work yourself, within the allowances described on the pricing page. Paid plans add a monthly Reach allowance, the number of unique people we can source into your missions in each monthly billing period, and execution by KiteGTM on the missions you start, within the permissions you set.

  • Plans are billed monthly in advance and renew until cancelled
  • Monthly Reach resets each billing period, and unused Reach does not roll over
  • Pausing a mission stops the work; it does not cancel the subscription
  • Cancelling ends paid execution at the end of the current period and keeps your free workspace and your data
  • Fees are non-refundable once billed, except where the law requires otherwise or where we have agreed otherwise in writing

Estimates are estimates

Where we show the size of a market or a range of introductions or other outcomes, it is a forecast based on your market, your criteria, channel availability and performance evidence. It is not a guaranteed quantity, not a purchased quantity, and not a promise of revenue. Your subscription includes every introduction we create, but it does not guarantee a number of them. Results vary with your market, your offer, and how you follow up.

What you are responsible for

  • Giving truthful information about your offer and your business
  • Targeting that is lawful and appropriate in the markets you choose
  • Introduction criteria that reflect what you actually want
  • Connecting the accounts and granting the permissions we need
  • Reviewing anything we escalate to you, and taking forward the introductions we hand over
  • Meeting your own obligations to the people we contact on your behalf, including under applicable marketing, privacy and anti-spam law

What we are responsible for

On a paid plan we source people into your missions using your plan’s monthly Reach, build and operate campaigns, manage follow-up, handle routine replies within the involvement and permissions you choose, apply your introduction criteria, and hand over introductions that meet them. We decide how to allocate effort within your plan and your mission, and we stop when a safety, consent, deliverability or capacity boundary is reached.

A paid entitlement does not authorise unlimited sending, unsafe automation, prohibited data acquisition, or activity outside the scope you approved.

Acceptable use

You may not use KiteGTM to:

  • Send unlawful, deceptive, harassing or misleading messages
  • Target people in ways that breach applicable law or platform rules
  • Attempt to bypass sending limits, consent requirements or suppression lists
  • Resell or redistribute the data we produce as a list product
  • Reverse engineer, scrape or overload the service

We may suspend an account that breaches this section, and will tell you why where we lawfully can.

Your data and ours

You keep ownership of the markets, criteria, people, introductions and conversation history in your workspace, and you can export them. We keep ownership of the platform, models, and anything we build that is not your data. We may use aggregated, de-identified information to improve the service.

Personal data is handled as described in our Privacy Policy.

Availability

We aim to keep KiteGTM available but do not promise uninterrupted service on the free plan. Any service level commitment applies only where it is stated in your plan or a separate agreement.

Liability

To the extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the thirty days immediately before the event that gave rise to it. Nothing here limits liability that cannot lawfully be limited.

Changes and ending the agreement

We may change these terms; if a change is material we will tell account holders by email before it takes effect. You can stop using KiteGTM at any time. We may end the agreement for a material breach, or with reasonable notice. We may suspend or end an account immediately for a material breach, non-payment, a chargeback, misuse of the service, or where continuing would create legal risk.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, except that either party may instead refer a dispute to arbitration in Toronto, Ontario under the Arbitration Act, 1991.
